What OG 27/2002 says about the response time
Romanian Government Ordinance 27/2002 on handling petitions applies to public authorities and institutions and the other bodies it lists. They must send the petitioner an answer within 30 days of registering the petition, whether the outcome is favourable or not (art. 8).
When the matter needs a more thorough investigation, the head of the institution can extend the deadline by at most 15 days (art. 9). In practice the extension is decided and communicated to the petitioner before the 30 days run out.
How the days are counted
The deadline runs in calendar days: the registration day is not counted and the term ends at the end of the 30th day. If that last day is not a working day (Saturday, Sunday or a public holiday), the term runs until the end of the next working day, following the general rule for computing time limits in the Romanian Civil Code. The calculator uses the public holidays listed in the Labour Code (art. 139), with Orthodox Easter and Pentecost worked out for each year.
Anonymous petitions, or ones without the petitioner's identification data, are not considered and are filed away, and a petition sent to the wrong institution must be forwarded to the competent one within 5 days of registration.
Some areas have their own rules (for example complaints to utility providers or requests for public information under Law 544/2001). This page gives general information and is not legal advice.
Worked example
A petition registered on Sunday, 1 November 2026. The 30th day is Tuesday 1 December 2026, Romania's National Day and a public holiday, so the answer is due on Wednesday 2 December 2026. With the extension, the 45th day is 16 December 2026, a working day.
Frequently asked questions
Are the 30 days working days or calendar days?
Calendar days. Weekends and holidays only matter at the end: if the 30th day is not a working day, the deadline moves to the next working day.
Is the registration day counted?
No. Counting starts on the day after registration. A petition registered on 5 March is normally due on 4 April.
How long can the deadline be extended?
By at most 15 days, so 45 days in total from registration, when the petition needs a more thorough investigation. The head of the institution decides.
Which public holidays are included?
All of those in the Romanian Labour Code: 1 and 2 January, 6 and 7 January, 24 January, Orthodox Good Friday, Easter Sunday and Monday, 1 May, 1 June, Pentecost Sunday and Monday, 15 August, 30 November, 1 December, 25 and 26 December.
